Francisco Aguilera: $150K Complaint Against Fidelity Advisor

Altamonte Springs financial advisor Francisco Aguilera (CRD# 6024692) allegedly misrepresented an investment, according to a recent complaint filed against him. Financial Industry Regulatory Authority records show that he is a broker and an investment advisor with Fidelity Brokerage Services, having previously been registered with Strategic Advisors. 

Mr. Aguilera’s BrokerCheck report discloses one investor complaint. Filed in August 2022, it alleges that as a representative of Fidelity Brokerage Services, he misrepresented an investment as principal-protected. The pending complaint alleges damages of $150,000.

Securities industry rules and standard prohibit brokers like Mr. Aguilera from making misrepresentations of material facts regarding the investments they recommend to their customers. Perhaps the most pertinent regulation regarding misrepresentation is FINRA Rule 2020, which stipulates that no broker shall “effect any transaction in, or induce the purchase or sale of, any security by means of any manipulative, deceptive or other fraudulent device or contrivance.” A material fact is a piece of information that would pose a significant consideration to investors considering a product or strategy, such as whether their principal investment would be protected. Brokers who misrepresent investments may be liable in the event of losses.

According to the Financial Industry Regulatory Authority, Francisco Aguilera holds 10 years of securities industry experience. Based in Altamonte Springs, Florida, he has been a broker with Fidelity Brokerage Services since 2012 and an investment advisor with Fidelity Personal and Workplaces Advisors since 2018. He was previously registered with Strategic Advisors in Altamonte Springs from 2013 until 2018. His credentials include the passage of five securities industry qualifying exams: the General Securities Sales Supervisor – Options Module Examination, or Series 9; the General Securities Representative Examination, or Series 7; the Securities Industry Essentials Examination, or SIE; the Uniform Securities Agent State Law Examination, or Series 63; and the Uniform Combined State Law Examination, or Series 66.
