Eric Zwilling: Did Merrill Lynch Advisor Misrepresent Investment?

A recent investor complaint against Dublin, Ohio financial advisor Eric Zwilling (CRD# 4208417) alleges he provided misleading information regarding an investment. Records maintained by the Financial Industry Regulatory Authority show that he is a broker and an investment advisor with Morgan Stanley, having previously been registered with Merrill Lynch.

Mr. Zwilling’s BrokerCheck report discloses one investor complaint. Filed in November 2022, it alleges that as a representative of Merrill Lynch, he misrepresented material facts relating to a variable universal life insurance policy in March 2020. The pending complaint alleges unspecified damages.

Investors should be aware that the “misrepresentation” of material facts regarding investments is forbidden by FINRA rules and other securities industry standards. Perhaps the most relevant rule is FINRA Rule 2020, which stipulates that no broker shall “effect any transaction in, or induce the purchase or sale of, any security by means of any manipulative, deceptive or other fraudulent device or contrivance.” Brokers who provide investors with misleading information may be held liable for damages in the event of losses.

According to the Financial Industry Regulatory Authority, Eric Zwilling holds 22 years of securities industry experience. Based in Dublin, Ohio, he has been a broker and an investment advisor with Merrill Lynch since April 2021. His registration history includes Merrill Lynch (Columbus, Ohio; 2011-2021), UBS Financial Services (New Albany, Ohio; 2005-2011), and Merrill Lynch (Dublin, Ohio; 2001-2005). His credentials include the passage of three securities industry qualifying exams: the General Securities Representative Examination, or Series 7; the Securities Industry Essentials Examination, or SIE; and the Uniform Combined State Law Examination, or Series 66. He is licensed in Arizona, Delaware, Florida, Georgia, Illinois, Indiana, Maine, Massachusetts, Michigan, New Hampshire, New York, North Carolina, Ohio, South Carolina, Tennessee, Texas, West Virginia, and Wisconsin.
