Lakeville, Minnesota financial advisor Jeff Mahoney (CRD# 5333809) allegedly recommended unsuitable investments, according to a recent investor complaint. Financial Industry Regulatory Authority records show that he is registered as a broker with Van Clemens & Company and an investment advisor with Van Clemens Wealth Management, doing business as inFORM Financial Planning.
Mr. Mahoney’s BrokerCheck report discloses one investor complaint. Filed in December 2025, it alleges that as a representative of Herbert J. Sims & Company, he recommended unsuitable private placements between 2013 and 2019. The pending complaint alleges damages of $150,000.
FINRA Rule 2111 stipulates that brokers like Mr. Mahoney must recommend investments and strategies that are considered suitable for their clients. To determine whether an investment or strategy is suitable, they must conduct reasonable diligence into the client’s investment profile, which encompasses such factors as age, net worth, income, risk tolerance, investment goals and experience, and more. The broker must conduct reasonable diligence to ascertain whether an investment is suitable for some investors, whether it is suitable for the specific investor they’re dealing with, and, in cases where the advisor exercises discretion over trading in a customer’s account, they must conduct reasonable diligence to determine that a series of transactions is not unsuitable or excessive. The SEC’s Regulation Best Interest, meanwhile, similarly requires that brokers “act in the best interest of the retail customer at the time the recommendation is made, without placing the financial or other interest of the broker, dealer, or natural person who is an associated person of a broker or dealer making the recommendation ahead of the interest of the retail customer,” the regulation states. Representatives who recommend unsuitable investments may be found liable for damages.

Based in Lakeville, Minnesota, he has been registered as a broker with Van Clemens & Company and an investment advisor with Van Clemens Wealth Management since 2023. His past registrations include FBL Marketing Services, Herbert J. Sims & Company, and BC Ziegler & Company. His credentials include the passage of three securities industry qualifying exams: the Securities Industry Essentials Examination, or SIE; the Uniform Combined State Law Examination, or Series 66; and the General Securities Representative Examination, or Series 7.
