GWG Complaint Against Arque Capital’s Christy Earhart

Scottsdale, Arizona financial advisor Christy Earhart (CRD# 3236699) recently received an investor complaint alleging misconduct relating to an investment in GWG Holdings. Financial Industry Regulatory Authority records show that she is a broker registered with Arque Capital and the owner of Dave Smith Financial.

Ms. Earhart’s BrokerCheck report discloses one investor complaint. Filed in September 2022, it alleges that as a representative of Arque Capital, she breached her fiduciary duty, acted negligently, and violated state securities laws and FINRA rules in connection with an investment in GWG Holdings, which later filed for Chapter 11 bankruptcy. The pending complaint alleges unspecified damages.

In a statement included in the pending complaint’s disclosure, Ms. Earhart wrote that the allegations “are without merit” and that she “denies all allegations in their entirety.”

According to the Financial Industry Regulatory Authority, Christy Earhart holds 23 years of securities industry experience. Based in Scottsdale, Arizona, she has been a broker registered with Arque Capital since 2010. She is the owner of Dave Smith Financial. Her past registrations include Empire Securities Corporation in El Segundo, California, where she was registered from 1999 until 2010. Her credentials include the passage of four securities industry qualifying exams: the Investment Company Products/Variable Contracts Representative Examination, or Series 6; the General Securities Representative Examination, or Series 7; the Securities Industry Essentials Examination, or SIE; and the Uniform Securities Agent State Law Examination, or Series 63. She is licensed in Arizona, California, Colorado, Florida, Hawaii, Iowa, Nebraska, Nevada, Oregon, Texas, Virginia, and Washington. (Information current as of October 26, 2022.)
