Jonathan Zwickel: FINRA Bars Houston Broker

Former Clinger & Company broker Jonathan Zwickel (CRD#1724322) was recently named in a disciplinary action by the Financial Industry Regulatory Authority. He was barred over allegations he refused to cooperate with an investigation into whether he improperly engaged in an outside business activity.

According to a Letter of Acceptance, Waiver and Consent (No. 2020065586401) dated April 2020, Jonathan Zwickel was associated with Clinger & Company as a general securities representative and general securities principal from January 2011 until February 2020. The findings state that in 2020, FINRA initiated an investigation into “among other things, whether Zwickel violated FINRA rules by engaging in a potential undisclosed outside business activity.” The AWC Letter goes on to state that FINRA sent Zwickel a request on March 18, 2020 to provide on-the-record testimony pursuant to FINRA Rule 8210, which empowers FINRA to require persons under its jurisdiction to “provide information orally… and to testify at a location specified by FINRA staff” in connection to matters under its investigation. The findings also note that FINRA Rule 2010 requires that associated persons “observe high standards of commercial honor and just and equitable principles of trade.” According to FINRA, Zwickel acknowledged in a phone call on March 19, 2020 that he had received its request for testimony, but indicated that he would not appear for the requested testimony “at any time.” FINRA concludes that this refusal constituted violations of both FINRA Rule 8210 and FINRA Rule 2010. As a result of the foregoing alleged conduct, he was barred from acting as a broker.

Jonathan Zwickel is currently not registered as a broker or investment adviser. His previous registrations include Clinger & Company, Next Financial Group, H&R Block Financial Advisors, Texas Capital Securities, Block Trading, Waterhouse Securities, Prudential Securities, Dean Witter Reynolds, and Shearson Lehman Hutton. He has passed four securities industry qualifying examinations and his BrokerCheck report lists zero state securities licenses. (Information current as of June 2, 2020.)
