Anthony Mitus: Morgan Stanley Advisor Faces $700K Complaint

A recent investor complaint against Saginaw, Michigan financial advisor Anthony Mitus (CRD# 5613183) alleges that his investment strategy resulted in six-figure damages. Financial Industry Regulatory Authority records show that he is registered as a broker and an investment advisor with Morgan Stanley.

Mr. Mitus’s BrokerCheck report discloses one investor complaint. Filed in July 2026, it alleges that as a representative of Morgan Stanley, he implemented an investment strategy concerning the claimant’s unrelated business taxable income tax liability that, per the disclosure, “was not in their best interests.” The pending complaint alleges damages of $700,000.

FINRA registered representatives like Mr. Mitus are beholden to Regulation Best Interest, a Securities and Exchange Commission rule requiring brokers to act in a retail customer’s best interest when making a recommendation, rather than placing their own financial interests first. FINRA Rule 2111 imposes a related obligation: a broker must have “a reasonable basis to believe that a recommended transaction or investment strategy” fits the customer, arrived at through reasonable diligence into that customer’s investment profile. A tax-driven strategy involving direct investments, for instance, must account for the customer’s liquidity needs and tolerance for loss, not only the tax outcome. Where a broker also serves as an investment advisor, a fiduciary duty may apply on the advisory side of the relationship. Brokers who recommend unsuitable investments may be held liable in the event of losses.

According to the Financial Industry Regulatory Authority, Anthony Mitus holds three years of securities industry experience. Based in Saginaw, Michigan, he has been registered as a broker and an investment advisor with Morgan Stanley since 2022. Morgan Stanley is the only firm with which he has been registered, according to his BrokerCheck report. His credentials include the passage of three securities industry qualifying exams: the Securities Industry Essentials Examination, or SIE; the General Securities Representative Examination, or Series 7; and the Uniform Combined State Law Examination, or Series 66.
