Derek Copeland: SEC Fines Barred Ex-LPL Advisor

Former Charlotte, North Carolina financial advisor Derek Copeland (CRD# 4347572) was recently sanctioned and barred in connection with alleged rule violations. Financial Industry Regulatory Authority and Securities and Exchange Commission records show that he was formerly registered as a broker with LPL Financial.

Following the FINRA disciplinary action against Mr. Copeland in March 2025, the SEC undertook an enforcement action against him too. Filed in July 2026, the action, disclosed on his BrokerCheck report, alleged that Mr. Copeland failed to adequately disclose conflicts of interests associated with his clients’ “investments totaling more than $50 million in private real estate securities offerings for which Copeland was compensated, in substantial part, by the offerings’ sponsors.” In connection with these findings, he was censured and ordered to pay a fine of $125,000.

For reference, securities industry rules stipulate that investment advisers must uphold a fiduciary duty to place their clients’ interests above their own. It also includes a duty to completely disclose any conflicts of interest, and to operate in good faith and with loyalty to their clients. The fiduciary standard is similar to but distinct from the suitability standard established by FINRA Rule 2111, requiring brokers to recommend only investments that are aligned with a client’s background and objectives.

According to the Financial Industry Regulatory Authority and the SEC, Derek Copeland holds 21 years of securities industry experience. Most recently based in Charlotte, North Carolina, he was last registered as a broker with LPL Financial from 2020 until 2023. His past registrations include Spire Securities, Morgan Stanley, Morgan Stanley & Co. Incorporated, and UBS Financial Services. His credentials include the passage of five securities industry qualifying exams: the Securities Industry Essentials Examination, or SIE; the National Commodity Futures Examination, or Series 3; the General Securities Representative Examination, or Series 7; the Uniform Combined State Law Examination, or Series 66; and the Uniform Securities Agent State Law Examination, or Series 63. He is no longer registered as a broker or an investment advisor. (Information current as of July 21, 2026.)
