Certior Financial’s Gary Gallagher: FS Energy & Power Complaint

King of Prussia financial advisor Gary Gallagher (CRD# 5745751) alleged misrepresented an investment in FS Energy & Power Fund, according to a new investor complaint. Financial Industry Regulatory Authority records show that he is a broker with Mutual Securities and an investment advisor with Certior Financial Group.

Mr. Gallagher’s BrokerCheck report discloses one investor complaint. Filed in November 2022, it alleges that as a representative of Voya Financial Advisors, he made misrepresentations regarding the risk and potential loss of principal of an investment in FS Energy and Power Fund. The pending complaint alleges damages of $74,409.

Investors should be aware that brokers are forbidden by FINRA rules from misrepresenting material facts relating to an investment or investment strategy. Securities industry rules and standards prohibit both fraudulent misrepresentation, which encompasses the intentional provision of misleading information, as well as negligent misrepresentation, which encompasses the careless provision of misleading information. Common forms of misrepresentation include the provision of misleading information regarding an investment’s risk or whether it comes with the potential for the total loss of principal. Investors who suffer losses on investments that they made as the result of misrepresentations may be able to bring a claim against their broker.

According to the Financial Industry Regulatory Authority, Gary Gallagher holds 12 years of securities industry experience. Based in King of Prussia, Pennsylvania, he has been a broker with Mutual Securities and an investment advisor with Certior Financial Group since 2016. His credentials include the passage of three securities industry qualifying exams: the General Securities Representative Examination, or Series 6; the Securities Industry Essentials Examination, or SIE; and the Uniform Combined State Law Examination, or Series 66. He is licensed in Massachusetts, Nevada, New Jersey, New York, North Carolina, Pennsylvania, and Virginia. (Information current as of December 13, 2022.)
